AskFbgTX is operated by STW Kollektiv, LLC (doing business as "AskFbgTX"). In these Terms, "AskFbgTX," "we," "us," or "our" refers to STW Kollektiv, LLC. These Terms of Use govern your use of the AskFbgTX website at askfbgtx.com and the AskFbgTX mobile app for iOS and Android (together, the "Service"), a free AI-powered travel guide for Fredericksburg, Texas, featuring an AI concierge named Fritz.
By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
1. Who may use the Service (18+)
The Service is intended for adults 18 years of age or older. Fredericksburg is a wine-country destination, and the Service includes information about wineries, tasting rooms, breweries, and other alcohol-related businesses. By using the Service, you represent that you are at least 18. If you are under 18, please do not use the Service.
2. What the Service is
Fritz is an AI guide that provides information and suggestions about Fredericksburg and the Texas Hill Country — wineries, restaurants, lodging, events, the outdoors, and trip planning — for general informational and planning purposes only. The Service is a convenience to help you explore the area; it is not a booking, reservation, or transaction service, and it is not a substitute for your own judgment.
3. Accuracy — "confirm before you go"
Fritz's answers are generated by artificial intelligence and may be inaccurate, incomplete, or out of date. Details that change often — hours, prices, availability, reservations, menus, event dates, road and weather conditions, and whether a place is currently open — can be wrong. Always confirm directly with the business or an official source before you rely on anything, make a reservation, spend money, or head out. You are responsible for verifying anything important to your plans.
4. Featured partners and advertising
Some local businesses pay to be featured on the Service (for example, a highlighted "Featured partner" listing or map marker) or to advertise with us. A featured or partner designation is a paid placement — a form of advertising — and is not an independent endorsement, ranking, or guarantee of quality. We disclose paid relationships so you can tell the difference. Fritz's other, non-partner suggestions reflect our own curated information and are provided as friendly, general suggestions rather than professional advice or paid endorsements. We also promote the Service through third-party advertising and analytics platforms (such as Meta), as described in our Privacy Policy.
5. Connecting you with local businesses
A feature of the Service is helping you get connected to local businesses, including real estate agents and other partners. We share your contact information with a business only when you explicitly ask us to be connected (see the Privacy Policy). If you request a connection, the business may contact you to follow up. We do not guarantee that any business will respond, that any particular business is available, or any outcome. Any dealings, communications, bookings, or transactions between you and a business are solely between you and that business, and we are not a party to them and are not responsible for them.
6. Third-party businesses and links
We reference independent businesses, venues, and places that we do not own or control, and the Service may link to third-party websites and booking pages. We are not responsible for those businesses or sites, their offerings, availability, content, or your experience with them. Their own terms and privacy policies apply to your dealings with them.
7. No professional advice
Fritz does not provide medical, legal, financial, real-estate, tax, or other professional advice. Information from the Service is general in nature. For advice about your specific situation, consult a qualified professional.
8. Acceptable use
When using the Service, you agree not to: use it for any unlawful purpose; attempt to gain unauthorized access to, disrupt, or damage the Service or its systems; scrape, harvest, or use automated means to extract data or overload the Service; misuse Fritz to generate unlawful, harmful, hateful, or deceptive content; misrepresent your identity; or infringe the rights of others. We may suspend or limit access to anyone who misuses the Service.
9. Our content and intellectual property
The Service — including Fritz, the AskFbgTX name and branding, the curated Fredericksburg knowledge base, text, and design — is owned by STW Kollektiv, LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-commercial license to use the Service for planning your own trip. You may not copy, scrape, resell, republish, or commercially exploit the Service or its content without our written permission.
10. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any information it provides is accurate, complete, or current.
11. Limitation of liability
To the fullest extent permitted by law, STW Kollektiv, LLC and its owners, members, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of — or reliance on — the Service or Fritz's information, including any experience with a business you learned about through the Service. Because the Service is provided free of charge to you, to the fullest extent permitted by law our total liability to you for any claim relating to the Service will not exceed one hundred U.S. dollars ($100).
12. Indemnification
You agree to indemnify and hold harmless STW Kollektiv, LLC and its owners, members, and providers from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
13. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that any dispute relating to the Service or these Terms will be brought exclusively in the state or federal courts located in or serving Gillespie County, Texas, and you consent to their jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice within the Service. Your continued use of the Service after an update means you accept the revised Terms.
